Fuzz n’ Buzz values the trust of its customers and is committed to protecting their personal data and the personal data of their owners in all situations where personal data is processed. In compliance with these principles and purpose, this Privacy Policy has been prepared and is based on its commitment to comply with the rules of personal data protection.

This Policy is intended to inform Customers of the general rules for processing personal data, which are collected and processed in strict compliance with the provisions of personal data protection legislation in force at any given time, namely Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (“GDPR”).

III. What is personal data?

Any information, of whatever nature and whatever its medium, including sound and image, concerning a natural person who is identified or identifiable by reference to a name, identification number, location data, electronic identifiers, or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural, or social identity.

IV. How is personal data processed?

Data processing consists of an operation or set of operations performed upon personal data or sets of personal data, whether by automated means, including collection, recording, organization, structuring, storage, adaptation, retrieval, consultation, use, disclosure, dissemination, comparison, interconnection, restriction, erasure, or destruction.

VI. What data do we process?

To correctly perform all the tasks associated with our activity, it is necessary to process your data. The data to be processed are your name, address, telephone contact number, and e-mail address, taxpayer, and citizen numbers (among others) according to the contact means provided on our website.
Without prejudice to compliance with legal regulations regarding the storage and transmission of data for the purpose of investigation, detection, and prosecution of serious crimes, as well as other processing to which it is legally obliged, the data will be processed for the respective provision of services and may also be processed for marketing purposes or dissemination of offers of goods or services, if the respective holder has authorized it. Personal data will also be processed, if the respective holder has authorized it, for the purpose of disseminating information services and lists, within the scope of the universal service, including transmission to third parties for publication of said lists and provision of information services. If prior consent has been given by the Customer, this may be withdrawn at any time, without, however, the lawfulness of the processing carried out based on the consent previously given being compromised.

VII. How do we collect data?

By telephone, in writing, through our website, ensuring, whenever necessary, the prior consent of the holder of the personal data. Some personal data is essential to Fuzz n’ Buzz activity and if this data is missing or insufficient, Fuzz n’ Buzz will not be able to provide the service or product in question.
The personal data collected may be processed by computer in an automated or non-automated manner, guaranteeing strict compliance with personal data protection legislation in all cases, and will be stored in specific databases or on a physical medium that is duly stored in a place of restricted and secure access created for the purpose and, under no circumstances will the data collected be used for any purpose other than that for which it was collected or with the consent of the holder of the data.

VIII. How long do we keep the data?

The period for which personal data are stored and retained varies according to the purpose for which the information is processed.

Thus, and whenever there is no specific legal requirement, the data will be stored and kept only for the minimum period necessary for the pursuit of the purposes that motivated their collection or their subsequent processing, under the terms defined by law.

IX. What are your rights?

  • Access to the information we hold about you;
    The holder of personal data has the right to receive confirmation from Fuzz n’ Buzz that data concerning them is or is not being processed and, if this is the case, to access their personal data and the information required by law.

  • Rectification of information if it is incorrect or incomplete;
    The holder of personal data has the right to rectify data which is incorrect or incomplete.

  • Erase or limit the processing of your personal data;
    The data subject has the “right to be forgotten”, i.e. the right to ask Fuzz n’ Buzz to delete your data. Fuzz n’ Buzz is obliged to delete personal data when one of the following situations applies:
    (a) the personal data is no longer necessary for the purpose for which it was collected;
    b) the owner has withdrawn his/her consent for the processing of his/her data and there is no other reason for said processing;
    c) the data subject opposes the processing and there are no other legitimate interests justifying further processing.

  • The data subject shall have the right to limit the data processed if one of the following situations applies:
    (a) to contest the accuracy of their data, within a period that allows Fuzz n’ Buzz to verify it.
    b) the processing of data is legitimate and the data subject opposes its deletion and, on the contrary, requests its limitation;
    c) Fuzz n’ Buzz no longer requires the data to be processed but the data subject requests such data for the purposes of asserting, exercising or defending a right in legal proceedings;

  • If the data subject has opposed the processing, until it is proven that the legitimate reasons of the data controller override those of the data subject;

  • Right to data portability;
    If the processing is dependent on the data subject’s consent and such consent has been given by automated means, the data subject shall have the right to receive the personal data concerning him or her in an accessible and easily readable format.

  • Right to object;
    The data subject shall have the right to object at any time to the processing of data concerning them.
  • Right to file a complaint – The data subject shall have the right to file a complaint directly to the National Commission for Data Protection (CNPD), preferably by using the online form, available in www.cnpd.pt. The data subject also has the right to refer the complaint to a national court of law, under the Portuguese law applicable.

  • Opposition to receiving contacts for marketing purposes;
    Fuzz n’ Buzz may promote actions to inform its Customers of new products or services, particularly by telephone, email, SMS, MMS or any other electronic communications service, if the holder of the personal data has given their consent.

If the holder of the personal data does not wish to continue to receive these communications they may, at any time, withdraw consent to the use of their data for marketing purposes.
With the periodicity of 1 year will require the renewal of the Customer’s consent which, if not given, will imply the immediate cancellation of any marketing communications

X. Do we disclose your data to other entities?

Fuzz n’ Buzz, as part of its business, may use third parties to provide certain services. Sometimes, the provision of these services involves these third parties having access to the personal data of Customers. When this occurs, the appropriate measures are taken to ensure that the entities that have access to the data are reputable and offer the highest guarantees at this level, which is duly established and safeguarded contractually between Fuzz n’ Buzz and the third party(ies). Therefore, any entity subcontracted by Fuzz n’ Buzz shall process the personal data of its Customers in the name and on behalf of Fuzz n’ Buzz and shall adopt the technical and organizational measures required to protect the personal data against accidental or unlawful destruction, accidental loss, alteration, unauthorized disclosure, or access and against any other form of unlawful processing. In all cases, Fuzz n’ Buzz remains responsible for the personal data that is made available to it.

XI. Personal data security

We have implemented the necessary technical and organisational measures in accordance with legal requirements to protect the personal data of our customers, ensuring confidentiality in accordance with the rules set out in this policy. Connections to our website are encrypted using an SSL (Secured Sockets Layer) digital security certificate, provided that an SSL-enabled browser is used.

XII. Changes to the data protection policy
